Agreement

Firstly,

At Epitome Studios, our goal is always to deliver work that meets your needs and achieves your objectives. To ensure clarity and protect both parties, this agreement sets out the expectations, responsibilities, and procedures should circumstances change.
We have no intention of misleading you or binding you to terms you may later regret. This agreement exists solely to ensure transparency, fairness, and mutual protection, now and in the future.

The Client is engaging Epitome Studios (“Epitome”) to produce the items outlined in the approved quotation, for the estimated total price agreed upon in prior correspondence.

 

The Client agrees to:

• Review all deliverables promptly

• Provide consolidated feedback in a timely manner

• Grant written approval/sign-off where required

• Adhere to the payment schedule set out in this agreement

Epitome confirms that it has the experience, skills, and resources necessary to deliver the agreed services professionally and within reasonable timelines.

 

Payment Terms

The Client agrees to pay Epitome for [Project Name] as follows:

 

50% deposit payable before production commences

• 25% of the deposit becomes non-refundable from 14 days before project commencement

• Cancellation within 10 days of project commencement results in 50% of the deposit being non-refundable

 

50% balance payable upon delivery of the production

• This includes any additional charges or revisions outside the scope of this agreement

 

Ownership & Usage Rights

• Upon full payment, the Client owns the final approved deliverables for [Project Name], including associated copyright and distribution rights.

• Epitome retains the right to use excerpts, stills, or footage from the project for portfolio, promotional, and marketing purposes.

• Backup footage will be retained until final delivery is accepted, unless otherwise agreed in writing.

• Raw footage remains the property of Epitome and will not be released or shared unless explicitly agreed to and reflected in the quotation.

Production Information & Changes

All production-related information must be supplied to Epitome before the first filming day.

Any information omitted, altered, or added after filming has commenced may:

• Affect the final outcome

• Require additional time or resources

• Be re-quoted accordingly

 

Secondly,

Revisions & Additional Work

The Client may request:

• One revision following the initial draft/screener

• One minor revision on that first revision

Any further revisions, changes, or administrative work beyond this will be billed at Epitome’s standard rate of R500.00 per hour.

 

Technical Support & Delivery Issues

If the Client experiences technical difficulties deploying the final video (including broadcast, digital platforms, or network delivery), Epitome can provide technical support at the standard rate of R500.00 per hour, unless otherwise stated in the quotation.
This includes liaising with platforms or networks until delivery is successfully completed.

 

Footage Protection & Force Majeure

Epitome will take all reasonable steps to back up and protect footage. However, in the extremely rare event of footage loss or damage due to criminal activity, equipment failure, or unforeseen circumstances:

• 50% of the deposit will be retained to cover services rendered

• 50% of the deposit will be refunded

• The Client will be released from payment of the remaining 50% production balance

 

Lastly

Termination & Contract Validity

• This agreement is non-transferable and concludes upon completion and delivery of the final project.

• If the Client terminates the agreement for reasons other than non-performance by Epitome, the Client remains liable for all services rendered up to the date of termination.

• This agreement remains valid without the need for renewal unless superseded by a new written contract.
