Agreement
Firstly,
We will always do our best to fulfill your needs and meet your goals, but sometimes it is best to have a few simple written words for both parties to understand each other, and what happens if things go wrong. We have no desire to trick you into an agreement that you might regret later. We do want what’s best for the safety of both parties, now and in the future.
Client is hiring Epitome to produce the items on the quote for the estimated total price as outlined in our previous correspondence. You agree to review our work, provide feedback and sign-off approval in a timely manner. You also agree to stick to the payment schedule set out in this contract. Remember that we have the experience and ability to perform the services you need from us and we will carry them out in a professional and timely manner.
Epitome agrees to create [Project] for client, and further
Client agrees to pay Epitome for [Project] in the following manner:

50% deposit due before production starts (25% of the deposit is non-refundable until 14 days before project commencement. Cancellation within 10 days of project commencement will result in 50% of the deposit being non-refundable).

50% payable on delivery of production (balance including any additional charges and revisions beyond this contract agreement).

Epitome agrees that client owns the final product created for [Project], including any copyrights, distribution rights, etc. However, as we are usually proud of our work, client agrees that Epitome may use the recorded footage as evidence of our work for promotional advertising purposes.

Backup footage will be kept until accepted delivery of final product unless otherwise agreed to.

Raw footage belongs to epitome and will not be released or shared unless otherwise agreed to, in which case it will be added to the quote.

All information regarding the production needs to be submitted to Epitome before the first filming day. Any omitted information or additional information regarding the production given after the first day of filming may cause changes to the final project and will be re-quoted for.
Secondly
We don’t want to limit either your options or your opportunities to change your mind. If you do want to change your mind, you will be charged the rate set out in the estimate we gave you. Along the way we might ask you to put requests in writing so we can keep track of changes. Epitome agrees that client may request one revision after the original screener or draft, and one additional minor revision on this first revision. Any changes or administration after this point will be charged for at our standard rate of R450.00 per hour.
If you have any problems implementing the video to its final destination, we can provide technical advice and assistance at our standard rate (unless otherwise stated in the quote) if your video was intended to be broadcast on digital or television and you are having trouble with the network/platform accepting or receiving your video we will work with you and/or the network/platform at our standard hourly rate of R450.00 until the video is delivered (unless otherwise stated in the quote).
Epitome will always backup and protect footage to the best of our ability, but in the extremely rare case that footage is lost or damaged due to criminal activity, faulty equipment or other unforseen circumstances client agrees that 50% of deposit is non-refundable for service charges. Epitome will refund client 50% deposit and renounce client from final 50% production charge.
Lastly
This contract is not transferable and becomes void upon completion of final project. If this contract is terminated by the client for any reason other than non-performance by Epitome or reasons stated above will result in full payment of the services provided to the date of termination. This contract stays in place and need not be renewed.
